Explanation of Flat Fee Rates and Services Kate Fitz Gibbon provides legal advice for standard issues and situations at a predetermined, flat fee. She believes that an informed client is a happy client. Fees may be higher based upon special circumstances. She will be happy to discuss these and other fee arrangements in detail with you. All fee arrangements will be presented in writing. Flat fee legal rates are cost-effective and provide clients with certainty about legal expenses. Simple Estate Planning Services. Consultation and preparation of a simple will $450. Consultation and preparation of simple wills for husband and wife or domestic partners $600. Consultation and preparation of simple wills with simple testamentary credit shelter trust for husband and wife or domestic partners $1000. Intervivos/living trust $1400 - $2000. Recording fees for real property additional. Durable powers of attorney for medical and financial matters. $150. Family wills, credit shelter trust (and marital trust if appropriate), advanced health directives, property transfer, and durable powers of attorney package $2000. There are inherent conflicts of interest in having one attorney or firm prepare wills for both husband and wife or domestic partners. Conflicts may be waived after a full discussion with your attorney or separate legal review should be sought. Contract Review. We will be glad to review your proposed agreement or contract and discuss your concerns. We will provide you with specific advice and can make revisions to an existing contract to better meet your needs. Flat fee services do not include review of business or real estate sale agreements, lengthy or complex contracts, rewriting the contract, negotiation or formal, written legal opinions. Please be prepared to supply us with all the documents related to correspondence and transaction. Flat fee $375. Flat fee contract review agreements are limited to 3 hours of the attorney’s time. Should you wish to add additional services, we will give you a detailed cost list and description of services to be provided and will apply your flat fee to your total bill. Nonprofit-based Services. Incorporation of New Mexico Nonprofit Corporation, including articles of incorporation, bylaws, policies of governance, setting up and attending first organizational meeting, providing fiduciary advice. Flat fee service package $600-$900 depending on complexity of organization. Incorporation services as shown above plus filing of IRS Form 1023 or Form 1024 application for 501(c)(3) (to provide for tax deductibility of donations to the charity made by donors), 501(c)(4), 501(c)(6), 509(a)(2). Flat fee service package $1500-$2500. Preparation and filing of IRS Form 1023/1024 and New Mexico state regulatory filings without incorporation services or for not-for-profits that are not organized as corporations $700-$900, plus costs. These rates do not include filing fees set by state and federal government. Fees for state and federal nonprofit filings are set by the state and the IRS and in the case of the IRS, are based on existing or anticipated revenue.
